Welcome to oitoy.com.au (the "Site"), ABN 74 855 440 553. By accessing or using our Site, placing an order, or creating an account, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site.

1. Definitions

  • "We", "us", "our" and "OiToy" refer to the operator of this Site (ABN 74 855 440 553).
  • "You" and "your" refer to the person accessing our Site or placing an order.
  • "Site" refers to oitoy.com.au and all associated services.
  • "Products" refers to all goods available for purchase on our Site.
  • "Order" refers to a request to purchase Products through our Site.

2. Eligibility

Our Site is for adults, such as parents, carers and gift buyers, who are buying for children. By using our Site to place an order or create an account, you confirm that you are:

  • at least 18 years of age; and
  • legally capable of entering into binding contracts.

Children should not create an account, place an order or submit personal information on our Site.

3. Account Registration

You may create an account on our Site. When registering, you agree to:

  • provide accurate, current and complete information;
  • update your information to keep it accurate;
  • keep your login details confidential;
  • tell us promptly about any unauthorised use of your account; and
  • accept responsibility for activity under your account.

4. Prices and GST

  • All prices are in Australian dollars (AUD).
  • All prices shown on our Site include GST.
  • Shipping costs are calculated and shown at checkout. See our Shipping Policy.
  • Prices may change without notice. The price shown at checkout when you place your order applies to that order.

Pricing errors

We make every effort to ensure our prices are accurate. If we discover a pricing error after you place your order, we will:

  • contact you before processing the order;
  • offer you the option to proceed at the correct price or cancel your order; and
  • give you a full refund if you choose to cancel.

5. Orders and Acceptance

  • Placing an order on our Site is an offer to purchase the Products in your order.
  • Our order confirmation email acknowledges that we have received your order. It is not acceptance of your order.
  • Your order is accepted when we dispatch the Products and send you tracking information.
  • We may decline or cancel an order, including where there is a pricing error, the Product is unavailable, we suspect fraud, or the order breaches these Terms.
  • If we cancel your order, we will give you a full refund.

6. Product Information, Images and Colours

  • We aim to describe and show our Products accurately.
  • Product images are representative. The actual Product may differ slightly in colour, size or packaging because of manufacturer changes, updated packaging or your screen settings.
  • Many toys are sold in assorted colours or designs. Where a product page says "colour may vary", "assorted" or offers a random or surprise option, we cannot guarantee which colour or design you will receive.
  • Where a product page lets you choose a specific colour or design, we will send the option you choose, subject to stock.
  • Please check the product description, size and age guidance before ordering.

7. Stock Availability

  • Stock levels shown on our Site are updated regularly but are not guaranteed in real time.
  • If an item is out of stock after you place your order, we will email you to offer an alternative or a refund for that item.

8. Payment

  • We accept the payment methods shown at checkout.
  • Payment is required at the time you place your order.
  • Payments are processed through Shopify Payments and other payment providers and their payment processors, which handle your card details securely under their own terms and PCI-DSS standards.
  • If payment fails, your order will not be processed.

9. Shipping and Delivery

Please see our Shipping Policy for full details. In summary:

  • We ship Australia-wide with Australia Post, with Standard (Parcel Post) and Express (Express Post) options.
  • The shipping rate is calculated at checkout from the parcel weight and the delivery state.
  • Standard shipping is free on orders of $99 or more. Express shipping is always charged.

Delivery timeframes are estimates and are not guaranteed. Risk of loss passes to you on delivery.

10. Returns and Refunds

Please see our Return and Refund Policy for full details. Key points:

  • 30-day change of mind returns from delivery, for items that are unopened, unused and in their original packaging.
  • No restocking fee.
  • You pay the return postage on change of mind returns.
  • Faulty, damaged, wrong or not-as-described items are handled under the Australian Consumer Law, and we cover the return postage.
  • Your rights under the Australian Consumer Law are not excluded.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (ACL) or any other applicable law that cannot lawfully be excluded or modified.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

12. Age Guidance and Safe Play

  • Toys come with the supplier's age guidance on the packaging. Please read and follow the age labels, warnings and instructions supplied with each toy.
  • Please supervise young children during play.
  • Some toys contain small parts that may be a choking hazard for children under 3 years.
  • Products should be used for their intended purpose as described on the product page and packaging.
  • To the extent permitted by law, we are not liable for loss or injury caused by misuse of a Product or by not following its age guidance, warnings or instructions. This does not limit your rights under the Australian Consumer Law.

13. Intellectual Property

  • All content on this Site, including logos, images, text, graphics and design, is owned by OiToy or its licensors and is protected by Australian and international copyright law.
  • You may not reproduce, distribute, modify or create derivative works from any content on this Site without our prior written consent.
  • Product names, characters and brands shown on our Site are trademarks of their respective owners.

14. Prohibited Uses

You agree not to:

  • use our Site for any unlawful purpose;
  • breach any applicable Australian or international law or regulation;
  • transmit viruses, malware or any other harmful code;
  • attempt to gain unauthorised access to our systems or other users' accounts;
  • use automated systems (such as bots or scrapers) to collect data from our Site without permission;
  • interfere with or disrupt the operation of our Site; or
  • misrepresent your identity or your connection with any person or organisation.

15. Limitation of Liability

To the extent permitted by law, and without excluding any guarantee, right or remedy you have under the Australian Consumer Law:

  • we are not liable for any indirect, incidental, special or consequential loss arising from your use of our Site or Products;
  • our total liability for any claim relating to your use of our Site or your purchase of Products is limited to the amount you paid for the relevant Products; and
  • we are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, carrier delays, supply disruptions or government actions.

This limitation does not apply to any liability that cannot be excluded under the Australian Consumer Law.

16. Your Responsibility for Misuse

To the extent permitted by law, you are responsible for any loss, claim or expense we incur as a direct result of your breach of these Terms or your misuse of our Site, except to the extent the loss is caused by our own negligence or breach.

17. Third-Party Links

Our Site may contain links to third-party websites or services, including our social media pages. We are not responsible for the content, privacy practices or terms of any third-party website. Accessing third-party links is at your own risk.

18. Events Beyond Our Control

We are not liable for any failure or delay in performing our obligations where it results from circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, supplier failures, industrial disputes or transport disruptions.

19. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. The Terms in place when you place an order apply to that order. Your continued use of our Site after changes are posted means you accept the updated Terms.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

21. Governing Law and Disputes

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of our Site will be subject to the jurisdiction of the courts and tribunals of Victoria, Australia.

If you have a concern, please email us first so we can try to resolve it. For smaller consumer disputes, the Victorian Civil and Administrative Tribunal (VCAT) or the Australian Disputes Centre may also help.

22. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy and Shipping Policy, form the entire agreement between you and OiToy regarding your use of our Site and purchase of Products.
